The Sample Contract
 

 The Appendix of the Standard Contract

1.      Party A wishes to engage the service of Party B          .  

The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

2. The period of service will commence from 1st September, 2012  to 15th July, 2013 .

3. Party B's monthly salary will be        RMB Before Tax.

And, Party A will pay Party B 150 RMB allowance for electricity and water each month with the monthly salary. Party B should pay the electricity and water fee every months, Party B should pay it in cash. (Party B is advised to save sufficient cash for paying the said fee, as preceding examples suggest American expatriates saw their electricity bill soaring during summer time as a result of extended A/C use.)

4. Party B will receive a travel allowance of 2200RMB a year and a round-trip(including the trip the foreign teachers come to teach on September and the trip at the end of  the employment) economy class tickets(international economy class air ticket) from    via     /      to Wuyishan (the route should be the cheapest one and ticket price should be confirmed by Part A), International Airport to Party A’s campus. The travel allowance and reimbursement of the tickets will be paid as follows: the money for the first trip will be paid before the end of the first semester, while the other half will be paid with travel allowance with the last monthly salary.

5. Party B will enjoy the free use of the apartment, broadband system (a free account for ADSL or LAN connected Internet). Essential furniture and electrical equipment including water heater, air conditioner, refrigerator, washing machine, microwave oven, TV set, bed, table and chairs, TV bench (the above things can only be used by Party B during the employment term). Any expenses for service of the Wuyi University possessions caused while the things are beyond repair with personal reasons should be paid by Party B.

6. Party B is entitled to the paid vacation for holidays stipulated by Chinese laws and regulations. And also the summer or winter vacation in the duration of contract period with salary if the contract is a full year.

7. The duties and obligations of Party B

(1) Party B should provide the following original documents and certificates to Party A as soon as Party B arrives Party A’s campus:

a. passport.

b. diplomas.

c. English teaching certificate like TESOL or TEFEL.

d. health certificate certified by the medical institution authorized by Chinese embassy.

e. 5 two-inch-ID photo.

f. Party B should provide the following transportation bills to Party A for the round-trip allowance and reimbursement: traffic tickets, air ticket, boarding card (Party B should provide the formal invoice of air ticket issued by airlines if there is no air tickets). (p.s.: the tickets and formal invoices will be the necessary documents for Party A to pay the allowance and reimbursement, Party A can not pay the money if the transportation bills mismatch the expense formalities.)

(2) Party B shall observe the law, decreesrelevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.

(3) Party B shall observe Party A's work system and regulations concerning administration of foreign teachers and shall accept Party A's arrangement direction, supervision and evaluation in regard to his/her work. During the contract term, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

(4) Party B shall complete the tasks agreed on schedule and guarantee the quality of work to the best of party B's ability.

(5) Party B shall respect China's religious policy, and shall not conduct any religious activities (foreign teachers can have religious belief and perform related religious activities, but not allowed to lobby for fellow believers in China) incompatible with a teacher’s status as a foreign expert.

(6) Party B shall respect the Chinese people's moral standard and customs.

(7) Sick leave and private affairs leave:

a. Certificate from doctors should be presented when Party B asks for sick leave. If the sick leaves amount to less than 30 days within the contract term, Party B shall be paid with 100% of the salary only if Party B accomplishes the make-up lessons which were left out for the sake of Party B’s sick leave. In case the leaves exceed 30 days, Party A has the right to terminate the contract, or, if the contract is not terminated, 70% of the salary will be paid only if Party B accomplishes the make-up lessons which were not completed for Party B’s sick leave. Before Party B fulfills the make-up of teaching, Party A can postpone the paying of salary of the related month/s.

b. Private affairs leave of the employed party shall be approved by Party A. The private affairs leaves should not exceed 10 days. The continuous private affairs leave shall be no more than 3 daysParty B should accomplishes the make-up lessons which were left out for the sake of Party B’s private affairs leave, Party A will deduct 100.00RMB from Party B for every teaching period if Party B can not accomplish the make-up lessons. In case of absence from work without Party A's permission, the salary will be paid according to the mentioned terms after the reasonable explanations are given to Party A. For serious circumstances, Party A has the right to terminate the contract and take actions on Party B’s breach.

(8) Party A has the right to investigate the liability of Party B for violation of the contract. Party A has the right to terminate the contract if Party B is not qualified to the teaching position or violate the contract terms.

(9) Having sixteen teaching periods (45minutes per teaching period and excluding the break time) per week, teaching English language and other relevant skills;

(10) Acting as an extracurricular organizer or a coach such as English Corner totaling two hours each week;

(11) Preparing and writing lesson plans based on Party A’s teaching tasks and syllabus provided;

(12) Helping teachers of the relevant department to improve their English language competence and teaching skills.

8. Party A's Obligations

1 Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, Party A's work system and regulations concerning administration of foreign teachers.

2Party A shall conduct direction, supervision and evaluation of Party B's work.

3Party A shall pay Party B's salary regularly on the last day of every month.

4Party A will help Party B to process the related documents like working permit, insurance, health certificate, expert certificate and residence permit and pay the expenses for the mentioned documents. (the above expenses of Party B’s accompanied families should be paid by Party B.)

9. Revision, Cancellation and Termination of the Contract

(1) Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

(2) The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

(3) Party A has the right to cancel the contract with a written notice to Party B under the following conditions:

a. Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after party A has pointed it out.

b. According to the doctor's diagnosis, Party B cannot resume normal work after a continued 30-day sick leave.

(4) Party B has the right to cancel the contract with a written notice to Party A under the following conditions:

a. Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.

b. Party A has not paid party B as scheduled.

10. Breach penalty

When either of the two parties fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract; that party must pay a breach penalty. The breach penalty will be US$500 to 2000, or the equivalent in RMB, calculated pro-rata to the completed period of employment. If Party B asks to cancel the contract due to events beyond control, such as natural disaster, it should produce certifications by the department concerned, obtain Party A's consent. If Party B cancels the contract without valid reason it would pay its own return expenses and pay a breach penalty to Party A. If Party A or Party B asks to cancel the contract due to events beyond control, such as natural disaster, with the consent of Party B, it should pay Party B's return expenses; If Party A cancels the contract without valid reason, it should pay Party B's return expenses and pay a breach penalty to Party B.

11. This appendix has equal validity of the standard contract and comprises an integral part of the contract. It takes effect on the date signed by both parties and will automatically expire when the contract ends. If either or the two parties asks for new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.

12. Arbitration

The two parties shall consult with each other and mediate any disputes that may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign expert's affairs in State Bureau of Foreign Experts and ask for a final arbitration.
