1. Resume (including educational background and working experiences strongly suggested with commencement dates and completion dates);

3. Photocopy of the professional certificate (Teacher’s certificate or TESOL certificate);

Introduction
The school is a private coed school in Guangzhou in the south of China. It is one of the branch schools established by Group in 2001. Now nearly ten years old, it schools approximately 2,000 pupils aged three to fourteen, starting from Kindergarten, Primary School to Secondary School, with the latter on a separate campus.
The school is situated in a very affluent area (The Pearl River Delta), and it serves students from across Guangzhou, the Capital City of Guangdong Province, to students from some other Asian countries and regions like Korea, Thailand, Indonesia, Hong Kong, Taiwan and other continents. The Chinese students are ethnically in the majority.

Notes: The teaching load for each full time teacher is around 25 to 28 classroom hours a week. Schedule for Friday changes a little bit in the middle school, as the kids visit home that afternoon.

Living in Guangzhou
Guangzhou, located at the north of the Pearl River delta, is an important trading center as well as a busy port and the capital city of the province of Guangdong. The city has an area of over 16,000 square kilometers and a population of 6.7 million.
The climate of Guangzhou is sub-tropical. The average year-round temperature is 22C. August is the hottest month with an average temperature of 28C. January is the coldest month with an average of 13C. The rainy season falls between April and August. Average annual rainfall is 1,720 mm.
Like Athens of Greece and Rome of Italy, Guangzhou also has a history of more than 2,800 years.
There are a lot of interesting legends concerning its past. One of the beautiful stories which gives the city its name Goat Town says that five gods riding on five goats brought the first grain to the city. So, it is also known as the City of Five Goats. Besides tales and stories, here and there stand monuments of the city's democratic and revolutionary past. The monument to the Anti British struggle at San Yuan Li is in remembrance of the 1841 uprising against a British invading force. The Huang Hua Gang Park keeps alive the spirit of the 72 martyrs killed in an 1911 uprising against the Manchu dynasty. The National Peasant Movement Institute is the former cadre-training school founded and run by Mao Zedong and Zhou En Lai in 1925-1926. The Guangzhou Memorial Garden is in memory of those who lost their lives during the Communist Uprising in 1927.
Guangzhou is also one of the most important centers of foreign commerce in South China. The Chinese Export Commodities Fair has been held twice a year in the city since 1957. It is also a cultural center. There are several universities, the Zhongshan University, the South China University of Technology, the Jinan University and so on. There are also higher educational establishments. The city is renowned for its arts and crafts, namely the Guangdong embroidery, ivory-carving and ceramics.
Guangzhou is a beautiful city with an ever-green scenery and flowers blooming all the year round. The city boasts many tourist attractions, among which highlights are White Cloud Hill Scenic Spot. Yuexiu Park, Guangzhou Zoo, Six Banyan Temple and Flowery Pagoda, Dr. Sun Yatsen Memorial Hall, etc. In the Suburbs, there are such scenic spot on Conghua Hot Springs, Xiqiao Hill Scenic spot, Seven Star Crags, and Foshan City. Lots of tourists to Guangzhou like to cover one or two of them for out-of-city pleasure.
"Eating in Guangzhou" has become a popular saying both at home and abroad. Guangzhou ranks first in the number of restaurants and tea-houses in the country. Cantonese cuisine is good in color, fragrance, taste and presentation. In addition, the delicate Cantonese pastry is also well-known for its wide range of varieties, delicious flavor and beautiful color. Cantonese cuisine is among the most famous four in the country.
As for hotel accommodations, there are Garden Hotel, China Hotel, White Swan Hotel, Dongfang Hotel, Nanhu Hotel, the Overseas Mansion, the Overseas Chinese Mansion, the Overseas Hotel and others.
Our school is by the downtown of Guangzhou City, with a quarter’s drive, 75 miles to Hong Kong and 120 miles to Macao.
 
 
 
The Sample Contract
 

 

1. Contract duration
1.1. A Full Academic Year Contract:  
Commencement Date: September (Month) First (Day), 2010 (Year).  
Completion Date: July (Month) Tenth (Day), 20 11 (Year).  
But for the convenience of visa application of the School and for the security and validity for the Teacher to stay and book the airlines back home, the Completion Date of this contract as written above extends to the tenth (10th) of July.  The School shall not assign any job to the Teacher after 30th of June as that is the real completion date of the Contract.
1.2. A Half Year Contract: Commencement Date: ______(Month) _____(Day), 201____ (Year).   Completion Date: July (Month) Tenth (Day), 20 11 (Year). 
2. Appointment
2.1. The Teacher shall be employed as full time Teacher teaching at __________________,   on a full time basis, for a fixed term period.
3. Responsibilities and duties of the Employer
3.1. The School is responsible for getting the Teacher’s Residence Permit (a multi-entry visa), Foreign Experts Certificate and Certificate of Health Examination to make sure that the Teacher can work in China legally and the School shall pay all the respective fees.  If the spouse (not the employee of the School) of the Teacher and/or their children comes to China with them, the School shall assist the dependents of the Teacher to get each Residence Permit,   Certificate of Health Examination as well as a multi-entry visa, but these fees shall be paid by the Teacher.
4. Monthly salary
4.1. The School shall pay the Teacher a monthly salary of __________________ Yuan (RMB) after tax.
4.2. The pay days are as follows: October 8th, November 8th, December 8th, January 8th, February 8th (during winter break), March 8th, April 8th, May 8th , June 8th . The Teacher is strongly suggested to complete all the demission formalities in the inventory by July 6th and book any airlines after July 8th.
4.3. If the Teacher starts to work in the middle of a month, the School shall pay the Teacher according to the number of days that the Teacher has worked.  The daily wage shall be 1/30 of the monthly salary.
4.4. The above salary should be confidential and the Teacher must not disclose details of their remuneration to colleagues.
5. Flights
5.1. The School shall pay the Teacher international round-trip tickets (international economy class air ticket for the nearest distance between Guangzhou and the country of the Teacher). 
5.2. The School shall pay the Teacher the airfare in two payments: The first payment 5,000 Yuan RMB shall be on December 8th.   The second payment 5,000 Yuan RMB shall be on June 8th.
5.3. If the Teacher starts to work in the middle of the first semester, the School shall then pay the Teacher a prorated amount of airfare.
5.4. If the Teacher starts to work from the second semester, the School is not entitled to pay any airfare.
5.5. The Teacher shall complete all the demission formalities in the School inventory by July 6th, to make sure that the School Accounting Office is able to pay the June salary on July 8th.
5.6. If the Teacher terminates the contract prior to the completion date with/without an appropriate reason, the School is not entitled to pay any airfares.
6. Medical care
6.1. The Teacher receives the basic medical treatment and basic medicine free of charge at the School’s Clinic.
6.2. The School does not offer the Teacher any medical care when the Teacher is outside of Country Garden School’s property.
7. Insurance
7.1. The School shall buy medical and accidental insurance for the Teacher. The age limit for the participation in this insurance is under 55.
7.2. The School does not pay any insurance for a half-year contract.
7.3. The Teacher’s family member(s) will be entitled to participate, but the cost will be fully borne by the Teacher.
7.4. If the Teacher does not wish to participate then he/she will not be entitled to require that the value of the contributions be substituted by an increase in salary or reimbursement to expenses.
8. Accommodations
8.1 The School provides the Teacher the use of (at no charge) a furnished apartment with one bedroom, one bathroom, one kitchen and one sitting room together with bedding items, a TV with cable, a DVD player, a refrigerator, a microwave oven and a heating plate, an air-conditioner, a washing machine, a water heater, a water dispenser, and a sofa.
8.2 The Teacher shall use the Cable TV as well as the Internet connection in the School apartment at no charge.
9. Allowance
9.1. The School shall pay the Teacher 200 Yuan RMB each month during the period of the Contract as the allowance of water, electricity and gas.   The Teacher shall pay for overspend according to the price stipulated by the local government.  The School shall provide the monthly data record through the intranet in due time.
9.2. If the Teacher couple chooses to live in one of the School’s apartment, the School shall pay the husband (or wife) 600 Yuan RMB per month as housing allowance.
9.3. If the Teacher chooses not to live in the School’s apartment, he School shall pay the Teacher 600 Yuan RMB per month as rental allowance.
9.4. The School shall provide the Teacher three meals for free.
10. Holidays
10.1. During the time the Teacher works under Contract for the School, the Teacher shall enjoy all Chinese statutory public holidays.
10.2. The Teacher shall enjoy the paid winter holidays.
10.3 The School agrees to give the Teacher two additional days off for Christmas, December 25th and 26th (Boxing Day) without schedule changes.
10.4. If December 25th and/or 26th fall on a non-working day, no additional days shall be given off.
11. Chinese language training
11.1. The School provides the Teacher upon request a total of 1 Chinese training class (about 120 minutes) every week (except for the month of September and June).
12. Tuition discount
12.1. The Teacher enjoys the same tuition discount policy as the Chinese teachers should their children enroll in The School’s school.
13. Liaison
13.1. The School shall designate a teacher (usually the director or group leader in charge of English teaching) to be the Liaison in each section to help the Teacher concerning teaching and disciplinary procedures and a general Liaison (Joan Zhang) in the School FAO to take care of non-instructional services.
14. Disciplinary procedures
14.1. The Teacher, employed on a full time basis, agrees during the Contract to:
14.1.1. Diligently and competently discharge the duties of the Teacher as outlined in the ‘The Teacher’s Job Description’ in the Appendixes to this Contract.   The Teacher’s Job Description is a guide to the duties, professional responsibilities and core competencies pertaining to this job. The Appendixes are integral components with equal validity.
14.1.2. Devote the whole of the Teacher’s working time and attention to the affairs of the School and shall not undertake any extraneous activities which would, in the opinion of the School, be likely to interfere with the efficient discharge of the Teacher’s duties for the School.   In no circumstances shall the Teacher receive payments from any other employer without the written consent of the Principal, which shall not be unreasonably withheld.
14.1.3. Comply with the laws and regulations of the PRC and respect local customs and culture throughout his/her employment.   Unless clearly outlined in the teaching material the Teacher may not teach any forms of religious or sexual beliefs and/or standards.
14.2. The School is entitled to check the Teacher’s qualifications when the Teacher is being oriented. The Teacher shall present a resume, a copy of his/her passport, a copy of his/her diploma/degree, a copy of his/her teacher’s certificate, a cover letter, two recommendation letters from his/her most recent employer(s) as well as 6 recent photos (Visa type), for file data. If the School needs to check the original copy of the related certificates, the Teacher shall cooperate. If the Teacher’s last employer is within China, the recommendation letter should bear an official school stamp, in the Format stipulated by the Safea.
14.2.1. The School is responsible for the Teacher’s registration at the local PSB (so called public security bureau) after the Teacher arrives in China within 24 hours according to government regulations. If the PSB needs to interview the Teacher, the Teacher must cooperate. The materials needed for the registration are: a copy of the first page of the Teacher’s passport, a copy of the Visa page and a copy of the latest entry stamp page together with a recent photo of the Teacher.
14.2.2. Immediately after the Teacher is oriented and has signed this contract, the School shall take the Teacher to the designated hospital to have the aforementioned health check according to government regulations with the School paying all the respective fees. If the result of the Teacher’s health check does not meet the standard prescribed by the Chinese government, the Teacher shall leave China within a certain limit of time.
15. Illness and Absence
15.1. The Teacher shall be entitled to receive salary for certain periods of absence through sickness or injury: 7 days sick leave (A Day shall mean every day of the year inclusive of weekends, public holidays and the School holidays).
15.2. As early as possible on the first day of the absence, the Teacher should notify the Liaison’s office and/or the Liaison Section of the cause and likely duration of the period of absence. The Teacher must keep in regular contact with the Liaison’s office and/or Liaison Section during the full period of absence to ensure the School is fully informed in order to provide suitable work cover.
15.3. The Sickness Self-Certification form should be completed for Sickness Absence of up to 3 calendar days or less.
15.4. Should the period of absence exceed 10 calendar days, the School is entitled to terminate the Contract.
15.5. In cases where the Teacher is absent without contact or approval, the School is entitled to deduct the appropriate monies from subsequent salary payments.
15.6. The Teacher will not be entitled to any part of the salary if his or her absence is due to incapacity resulting from an injury for which he/she is able to claim damages from a third party.
15.7. The Teacher is not entitled to ask for private affairs leave unless it is a family or personal emergency, under this Contract. The Teacher is required to present a written letter to the Principal concerned to obtain approval.
15.8. The School shall not pay the Teacher during the private affairs leave. Private affairs leave should not exceed 7 days in this Contract; otherwise the contract shall become invalid automatically.
16. Subsidiary work
16.1. The Teacher may be required in addition of their duties to perform services not only for their section, but also for the whole School. The subsidiary work may include training activities, attending teaching workshops for the purpose of maintaining and updating the Teacher’s professional skills, school promotions, competition judging, test invigilation, group dinners, teachers’ union activities, etc.   If the Teacher is required to incur any costs associated with the duties requested in clause 18.1, the School is required cover said costs.
16.2. The School shall list the possible subsidiary work in the School calendar and present it to the Teacher when he or she is oriented. Any requirement to do any additional work will be considered in full consultation with the Teacher by giving reasonable notice (at least a week ahead), taking into account the Teacher’s personal, religious and domestic circumstances.
17. Probation (only applicable to the newly oriented teachers)
17.1. The probationary period will start on the Commencement Date of this Contract for a period of three months.
17.2. During the specified probationary period either party may terminate this Contract by giving at least 7 day’s notice in writing to the other party.
17.3. The probationary period shall automatically terminate after three months and provided that no notice of termination has been given during the probationary period the Teacher shall continue to be employed under the terms of this Contract.
17.4. The Teacher’s monthly salary does not fluctuate during the probationary period.
17.5. The School is not entitled to pay the Teacher the second payment of the airfare if the Contract is terminated by either party during the probationary period.
18. Working Hours
18.1. The Teacher is required to fulfill the duties and obligations described in the Appendix ‘The Teacher’s Job Description’.   The School must respect the Teacher’s religion and shall avoid weekend teaching for the Teacher.   If the weekend teaching is unavoidable because of the Government changes as scheduled in the School Calendar, the Teacher shall agree.
18.2. Any other requirement to work weekends shall be considered in full consultation with the Teacher and by giving reasonable notice (at least a week ahead), taking into account the Teacher’s personal, religious and domestic circumstances. 
19. Grievances
19.1. If the Teacher has a grievance relating to the disciplinary, or administration, the matter should be raised initially to the Liaison Section. The grievance should be raised orally in the first instance. In the event that the grievance relates to the section that would normally deal with a grievance at this stage, the grievance should be referred to the Liaison Office of the School.
20. Renewal of the Contract
20.1. The Teacher shall deliver the Liaison Office of the School a written notice, stating the decision whether to renew the contract or not 30 days prior to the completion of the Contract.
21. Termination of the Contract
21.1. Upon expiration of its term this Contract shall automatically and immediately terminate unless it is renewed subject to agreement of both Parties.
21.2. This Contract can be changed or terminated with the approval of both parties.
21.3. The School may terminate this Contract with a written notice to the Teacher under the following conditions:
21.3.1. If the Teacher is guilty of gross misconduct, gross negligence or gross incompetence.
21.3.2. If the Teacher fails to meet the requirements during the probation period.
21.3.3. If the Teacher has made no improvement in implementing Contract deficiencies after the Liaison Section has provided 2 oral warnings and 1 written warning to the Teacher in advance.
21.3.4. If the Teacher has accumulated more than 7 days for private affairs leave.
21.3.5. If the Teacher has accumulated more than 10 working days of sick leave.
21.4. The Teacher may terminate the Contract with a written notice to the School under the following conditions:
21.4.1. The School fails to provide the above mentioned working conditions.
21.4.2. The School fails to pay the Teacher on time.
21.4.3. During the probationary period.
22. Breach of the Contract
22.1. Following the statutory regulations mandated by government of China, when either of the two parties fails to fulfill the Contract or fails to fulfill the Contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$500.00 (or the equivalent in RMB).
22.2. If the Teacher asks to cancel the Contract due to events beyond its control, the Teacher should produce certifications by the department concerned 30 days in advance and obtain the School’s consent. The School shall then pay the Teacher a prorated amount of salary and airfare. If the Teacher terminates the Contract without an appropriate reason, the School has the right to refuse the Teacher payment of salary and airfare.  Furthermore, the Teacher is obligated to pay the School a penalty of US$500.00 (or the equivalent in RMB) for breaching the contract.
22.3. If the School asks to cancel the Contract due to events beyond its control, it should produce certifications by the department concerned 30 days in advance, obtain the Teacher’s consent, the School is required to pay the Teacher all the airfare and the rest of that month’s salary. If the School cancels the contract without valid reason, the School is obligated to pay the Teacher all the airfare, the rest of that month’s salary and a breach penalty of US$500.00 (or the equivalent in RMB).
22.4. The two parties shall consult with each other and mediate any disputes that may arise about the Contract. If all attempts fail, the two parties can appeal to the Organization of Arbitration for Foreign Experts’ Affairs in the State Administration of Foreign Experts Affairs in Guangzhou City and ask for a final arbitration.
23. Miscellaneous:
23.1. This Contract is effective from the date when the two parties sign their names.
23.2. This Contract is to be signed in both Chinese and English languages, with equal legal effect.
23.3. After the completion of the contract, the School shall be under no obligation to assign any duties to the Teacher and shall exclude the Teacher from its premises, although this will not affect the Teacher to receive the normal salary and other contractual benefits.   Other contract terms that either party determines is not covered by the standard contract will be faithfully negotiated and must be mutually agreed upon.

Appendix A Job Description

The Teacher agrees during the Contract to:

Devote the whole of the Teachers working time and attention to the affairs of the School and shall not undertake any extraneous activities which would, in the opinion of the School, be likely to interfere with the efficient discharge of the Teacher’s duties for the School. In no circumstances shall the Teacher receive payments from any other employer without the written consent of the Principal, which shall not be unreasonably withheld.
Comply with the laws and regulations of the PRC and respect local customs and culture throughout his/her employment.
Participate in a staff appraisal scheme. The staff appraisal scheme may include observation of classes, as well as the feedback from both peers and students. To be an active member of the teaching team at the designated section of the School, teaching to the highest level and contribute to the all-round extra-curricular life of the School. To be flexible and adjust to the needs of a new growing school, actively contributing to its development and growth.
Ensure that planning, preparation, recording assessment and reporting meet pupils’ varying learning and social needs. Adopt the appropriate teaching method to treat the students patiently and passionately. Physical punishment to the students is forbidden.
Report to parents on the development, progress and attainment of pupils, once a semester.
Review the curriculum biweekly and ensure that it is delivered through an effective timetable.

Maintain the positive ethos and core values of the school, both inside and outside of the classroom.

Share in promoting excellence in teaching, from productive teamwork to the self monitoring and improvement of teaching standards in school.
Be punctual and be strict with the attendance policy of the School.
 
Appendix B Staff Handbook
Personnel Policies and Procedures
Before Orientation
The teacher shall contact the School Liaison Office (herein referred to “Liaison”) stating the arrival time for the school timely pickup. Liaison shall arrange the school van to the Guangzhou Baiyun International Airport in due time.
Liaison arranges the in-school accommodations.
Liaison gets ready a temporary entrance permit to the community and school.
Orientation
The School will hold an orientation meeting for all the new teachers on the afternoon of 28th August around 4 o’clock.
The liaison from each section meets with the Expatriate teacher(s) at the meeting.
The liaison from each section shall provide the teaching materials and schedule before the meeting.
The Teacher shall sign the Contract.
Liaison shall guide the Teacher to finish the personnel and get their School ID number.
Liaison shall show the Teacher to the IT Center to get their School ID card made.
Liaison shall take the Teacher to register their information at the local PSB (Public Security Bureau) after he or she arrives in the school within 24 hours according to the government regulations. If the PSB needs to interview the teacher, he or she must cooperate.
Liaison shall take the Teacher to the designated hospital to have the health check usually after his/her arrival of 5 days.
If the result of the health check does not meet the standards prescribed by the Chinese government, the Teacher must leave China within a certain limit of time.
Validity of Contract
Liaison shall obtain the Teacher the necessary visas and permits for living and working in China.
The Teacher shall disclose full and honest educational information (including but not limited to qualification certificates), photo copy of their passport, six copies of their recent photos (passport type), and two satisfactory references from his/her previous employers.
The Teacher shall obtain an Enhanced Criminal Records Bureau Disclosure or equivalent that does not show any convictions which would render the Teacher unsuitable for the position.
The Teacher shall disclose full and honest medical history information to the School or the medical practitioner arranged by the School.
The teacher shall update their personal information if there are any changes.
Illness and Absence
The School Clinic shall take care of the common illness of the Teacher for free.
The Teacher should bring his/her School ID Card when seeing the doctor at the School Clinic.
The Section Liaison is advised to help if the Teacher needs like interpreting.
The doctor shall prescribe appropriate medicine(s) and write a sick notice to the related section liaison if necessary.
The Teacher is highly advised to go to the polyclinic to get specific treatment when necessary and/or emergent.
The doctor shall inform the following medicines and medical treatments that are not free: dental treatment, transfusion, physical therapy, herbal medicines, hospitalization and expert consultation, various tests, surgery, physical therapy, messages or acupuncture, health protection medicines, tonic and new or special medicines.
In cases where the Teacher is absent without contact or approval, the School is entitled to deduct the appropriate monies from subsequent salary payments. 50 Yuan RMB will be deducted for coming late for each scheduled class, 100 Yuan RMB for missing a scheduled class and 200 Yuan RMB for each working day absence..
The School Apartment Regulations
The School shall provide the Teacher with a furnished apartment, free of charge.
The Teacher who lives in the School Apartment must follow the School’s arrangements and cannot change the structure of the Apartment or replace the furnishings without the school’s permission.
The Teacher shall pay RMB 500 Yuan RMB as the Apartment utilities deposit. This money shall be deducted from the Teacher’s first month’s salary.
The Teacher is not entitled to rent the Apartment to any other people.
The Teacher shall cooperate with the School Gate Guards to get visitors registered.
The Teacher shall offer the School Liaison Office a written notice and obtain the permit prior to letting visiting relatives or friends stay overnight.
The Teacher is not allowed to keep pets in order to keep the apartment community safe and quiet.
The Teacher must take care of all the items in the apartment, and understand the right ways to operate the electric appliances to guarantee the safety of life and properties.
School Canteen Regulations
The School Canteen shall provide breakfast at 7:00, Lunch at 11:30, and supper at 5:30. Each service lasts about an hour.
The Teacher shall book the meals through the School’s Intranet system at least one week in advance. The Liaison Office shall provide help and notice in advance.
The Teacher shall scan their School ID card before taking the meal at Canteen.
If the Teacher happens to forget to book the meals, please ask the Liaison Office for help.
